1. Scope
These Terms and Conditions (T&C) apply to all purchases made through the online store of Maison Rivée KG by consumers within the meaning of the Austrian Consumer Protection Act (KSchG).
The version valid at the time of purchase shall apply.

3. Contract Conclusion
The product presentation in the online shop does not constitute a legally binding offer but an invitation to order.
By clicking the “Buy” button, the buyer submits a binding purchase offer.
The contract is concluded when Maison Rivée KG confirms the order by email.
4. Prices, Shipping, and Payment
- All prices are in Euro (EUR) and include statutory VAT but exclude shipping costs, unless otherwise stated.
- Payment methods are displayed during checkout (e.g., credit card, PayPal, Klarna, etc.).
- The purchase price is due immediately upon conclusion of the contract unless otherwise agreed.
4.1. Customs and Import Fees
For deliveries outside the European Union, customs duties, import taxes, and other applicable charges may be incurred.
These are not included in the purchase price and must be paid by the buyer.
Maison Rivée KG assumes no responsibility for customs clearance or related fees.
If the buyer fails to pay the customs or import duties and the shipment is returned to Maison Rivée KG, any costs, fees, or return charges incurred as a result will be deducted from the refund amount or charged to the buyer.
5. Retention of Title
All goods remain the property of Maison Rivée KG until payment has been received in full.
Before transfer of ownership, goods may not be pledged, resold, or otherwise disposed of.
6. Delivery
- Delivery is made to the buyer's address.
- Shipping costs are displayed during checkout.
- If an item is temporarily unavailable, the buyer will be notified and the amount refunded if the payment has already been made.

If the goods are delivered damaged, the damage must be documented immediately (including photos of the parcel) and reported to Maison Rivée KG. Otherwise, a return or refund cannot be accepted. The burden of proof regarding the notification lies with the sender.
7. Right of Withdrawal (FAGG)
Consumers have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which the buyer or a third party (other than the carrier) has taken possession of the goods.
To exercise the right of withdrawal, buyers must notify us of their decision to withdraw from the contract by means of a clear statement (e.g., by email or letter).

To meet the withdrawal deadline, it is sufficient to send the notice before the period expires. The burden of proof regarding the notification lies with the sender.
Consequences of withdrawal:
If buyers withdraw from the contract, Maison Rivée KG will reimburse all payments received (excluding standard delivery costs) within 14 days after receiving the returned goods. Refunds will be made using the same payment method used for the original transaction.
Returned goods must be in their original condition and must not show signs of wear beyond what is necessary to establish their nature and characteristics.
The buyer is responsible for the cost and safe return shipment. The return address therefore is Maison Rivée KG, Josefstädter Straße 7/16, 1080 Vienna, Austria. For further details regarding returns, please refer to Section 9 of these Terms and Conditions.
8. Secondhand / Vintage Items
Maison Rivée KG offers pre-owned and vintage items.
These items may show age- or use-related signs of wear, which are described transparently in each product listing.
For pre-owned items, the statutory warranty period is limited to one (1) year from the date of delivery (§ 9 KSchG).
Defects that were disclosed before purchase, described in the product listing, or clearly visible in product photos are excluded from warranty and liability.
9. Returns (Customer Responsibility)
- Returns are at the buyer’s expense.
- The buyer is responsible for insured and trackable shipping.
- Proof of return lies with the buyer.
- Unpaid (freight collect) returns will not be accepted.
- Returned goods must be in perfect condition with original packaging, tags and security tags.
- Items that are used, damaged, or missing tags will not be refunded or exchanged.

10. Warranty
- Statutory warranty provisions under §§ 922 ff. ABGB applies.
- Where defects exist, Maison Rivée KG may repair, replace, or refund the item at its discretion.
- However, no warranty or liability is accepted for defects that were clearly described, disclosed, or visible at the time of purchase.
11. Liability
Maison Rivée KG is liable only for intent and gross negligence.
For slight negligence, liability applies only to essential contractual obligations.
Liability for indirect or consequential damages and lost profits is excluded.
12. Data Protection (GDPR Compliance)
- Maison Rivée KG processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the Austrian Telecommunications Act (TKG).
- Data is processed for contract fulfillment, billing, and shipping.
- Data is shared only with service providers necessary to fulfill the contract (e.g., payment or shipping providers).
- Data is not transferred to third parties for advertising.
- Buyers have the right to access, rectification, deletion, restriction, and data portability.

13. Consignment Sales
MAISON RIVÉE acts as an intermediary between the owner (consignor) and the buyer in consignment sales. By submitting an item on consignment, the owner authorizes MAISON RIVÉE to present, promote, and sell the piece in the owner’s name and on their behalf. The selling price is determined in mutual agreement. Upon a successful sale, the owner receives their agreed share of the proceeds, minus the previously determined commission. During the consignment period, the item remains the property of the consignor. MAISON RIVÉE assumes no liability for loss or damage unless caused by gross negligence or intent. Unsold items may be reclaimed by the owner after the agreed consignment period has expired. Further details and individual terms are set out in a separate written agreement between the parties.
14. Applicable Law & Jurisdiction
All contracts are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods.
The exclusive place of jurisdiction is Korneuburg, Austria.
15. Final Provisions
- If any provision of these T&C is invalid, the validity of the remaining provisions remain unaffected.
- Amendments or additions must be made in writing.
